MINUTES

BOARD OF COMMISSIONERS                           LOWER ALLEN TOWNSHIP

               REORGANIZATION MEETING                          JANUARY 6, 2020                               

 

The following were in ATTENDANCE:

Township Secretary Helen Grundon called the January 6, 2020 Reorganization Meeting of the Board of Commissioners to order at 7:00 pm followed by the Pledge of Allegiance. She announced that Proof of Publication was available for review.

SWEARING IN OF NEWLY ELECTED OFFICIALS

District Justice Christopher Delozier administered the Oath of Office to the Commissioners H. Edward Black, Carolyn Holtzman and Thomas H. Kutz. The Commissioners took their seats on the dais.

 

NOMINATIONS AND ELECTIONS

Commissioner SCHIN nominated Dean W. Villone as President of the Board of Commissioners.  Commissioner KUTZ seconded the nomination. There were no other nominations.  Commissioner SCHIN moved that the nominations be closed.  Secretary Grundon closed the nominations and called the question.  Motion carried 5-0.

President Villone assumed control of the meeting and asked for nominations for Vice President.

Commissioner HOLTZMAN nominated H. Edward Black as Vice President of the Board of Commissioners. Commissioner KUTZ seconded the nomination.  There were no other nominations and Commissioner SCHIN moved that the nominations be closed.  President VILLONE  closed the nominations and called the question. Motion carried 5-0.

BOARD AND COMMISSION APPOINTMENTS/REAPPOINTMENTS

Commissioner SCHIN made a motion to reappoint Bruce E. Seagrist to the Lower Allen Township Vacancy Board for a two-year term, effective January 1, 2020. Commissioner KUTZ seconded. Motion carried 5-0.

Vice President BLACK made a motion to reappoint Ronald A. Massott to the Lower Allen Township Zoning Hearing Board for a term of three years, beginning January 1, 2020. Commissioner SCHIN seconded. Motion carried 5-0.

Commissioner SCHIN made a motion to reappoint Alison J. Shuler to the Lower Allen Township Stormwater Authority for a term of five years, beginning January 1, 2020. Commissioner KUTZ seconded. Motion carried 5-0.

Commissioner SCHIN made a motion to reappoint Alison J. Shuler to the Lower Allen Township Authority for a term of five years, beginning January 1, 2020. Commissioner KUTZ seconded. Motion carried 5-0.

Vice President BLACK made a motion to reappoint Peddrick M. Young, Sr. to the Lower Allen Township Development Authority for a term of five years, beginning January 1, 2020. Commissioner SCHIN seconded. Motion carried 4-1, with Commissioner HOLTZMAN opposed.

Commissioner KUTZ made a motion to reappoint Brett P. McCreary to the Lower Allen Township Planning Commission for a term of four years, beginning January 1, 2020. Vice President BLACK seconded. Motion carried 5-0.

Commissioner KUTZ made a motion to appoint Jeffrey M. Logan to the Lower Allen Township Planning Commission for a term of four years, beginning January 1, 2020. Commissioner SCHIN seconded. Motion carried 5-0.

Vice President BLACK made a motion to reappoint Scott W. Duncanson to the Lower Allen Township Recreation and Parks Board for a term of five years, beginning January 1, 2020. Commissioner KUTZ seconded. Motion carried 5-0.

Vice President BLACK made a motion to reappoint Terry L. Lenker to the Lower Allen Township Civil Service Commission for a term of six years, beginning January 1, 2020. Commissioner SCHIN seconded. Motion carried 5-0.

      

SWEARING IN OF REAPPOINTED OFFICIALS

District Justice Christopher Delozier issued the oath of office to Ronald A. Massott, Peddrick M. Young, Sr., Brett P. McCreary, Jeffrey M. Logan, and Scott W. Duncanson.

 

TOWNSHIP OFFICER APPOINTMENTS / REAPPOINTMENTS

Commissioner SCHIN made a motion to adopt Resolution 2020-R-01, a Resolution of the Board of Commissioners of Lower Allen Township, Cumberland County, Pennsylvania, appointing Ms. Helen R. Grundon as Township Secretary and appointing Mr. John M. Eby as Assistant Township Secretary for a two (2) year term and establishing compensation. Vice President BLACK seconded. Motion carried 5-0.

Vice President BLACK made a motion to adopt Resolution 2020-R-02 appointing Thomas G. Vernau, Jr. as Township Manager for a two (2) year term. Commissioner SCHIN seconded. Motion carried 5-0.

Vice President BLACK made a motion to appoint the firm of Daley, Zucker, Meilton, & Miner LLC, in the person of Steven P. Miner, as Township Solicitor, at a rate of $200.00 per hour, with Vicky Ann Trimmer serving as Alternate, effective January 1, 2020. Commissioner SCHIN seconded. Motion carried 5-0.

Vice President BLACK made a motion to appoint Daniel J. Flint, P.E. as Township Engineer, effective January 1, 2020. Commissioner SCHIN seconded. Motion carried 5-0.

Commissioner KUTZ made a motion to appoint John M. Eby as Township Sewage Enforcement Officer, and Gary Morrow as Alternate Sewage Enforcement Officer, effective January 1, 2020. Commissioner SCHIN seconded. Motion carried 5-0.

Commissioner SCHIN made a motion to appoint Richard A. Grove as Treasurer and Thomas G. Vernau, Jr. as Assistant Treasurer, effective January 1, 2020. Vice President BLACK seconded. Motion carried 5-0.

 

APPROVAL OF MEETING MINUTES 

Commissioner SCHIN made a motion to accept the meeting minutes of the December 23, 2019. Vice President BLACK seconded. Motion carried 5-0.

 

EMPLOYEE RECOGNITIONS

Vice President BLACK presented Aaron Duncan, Fleet Maintenance Mechanic, and Charles Reynolds, Fleet Maintenance Manager, commendation letters for their innovative efforts they put forth by working diligently in fabricating the road snow blower to fit the new John Deere tractor, saving the Township approximately $4.000.

President Villone stated that the regular Board of Commissioner meeting scheduled for January 13th has been cancelled.  The next meeting will be held on January 27th, 2020.

 

AUDIENCE PARTICIPATION

There was none.

 

BOARD PRESIDENT 

Commissioner SCHIN made a motion to approve the Check Register of January 3, 2020 in the amount of $158,630.14, and the Voided Check Register of December 2019, in the amount of $130,346.18. Commissioner KUTZ seconded. Motion carried 5-0.

 

ANY BUSINESS PERTINENT TO THE TOWNSHIP

There was none.

                         

TOWNSHIP ENGINEER

Time Extension for SLD Docket 2019-11

Commissioner SCHIN made a motion to accept a Time Extension for SLD Docket No. 2019-11: Land Development Plan for Cedar Cliff Sheetz, 1508 Cedar Cliff Drive, establishing a new expiration date of March 6, 2020. Vice President BLACK seconded. Motion carried 5-0.

Payment No. 5 to Penn State Construction

Vice President BLACK made a motion to authorize payment No. 5 in the amount of $119,795.13 to Penn State Construction for general construction on the Public Works Building Addition. Commissioner SCHIN seconded. Motion carried 5-0.

 

COMMUNITY AND ECONOMIC DEVELOPMENT

ZHB Docket #2020-01

The application of Global Video, Inc. and David Betesh, who are appealing the Zoning Officer’s decision to deny a zoning permit application for replacement sign cabinets installed on a freestanding sign structure located at 3401 Hartzdale Drive for use by Excitement Smokin and Excitement Adult Superstore. In the alternative, applicant is requesting a variance to exceed sign area limitations for freestanding signs located in the C-4 zoning district. Mr. Eby explained further that the work was done without authorization; no permit application, permits and inspection process and he has denied the after-the-fact sign permit application. This is now being appealed; therefore, Solicitor participation will be necessary. Commissioner SCHIN made a motion to allow Solicitor Miner to participate in the public hearing to assist in the appeal application and to oppose the variance request for Docket #2020-01. Vice President BLACK seconded this motion. Motion carried 5-0.

ZHB Docket #2020-02

The application of Scott D. Shaffer, 920 S. 29th Street, Camp Hill, PA 17011. Mr. Eby stated that Mr. Shaffer has provided sufficient narrative and exhibits on all five variance criteria; therefore, solicitor participation is not being requested.

1425 Slate Hill Road

Mr. Eby explained the reasoning for not requiring a land development plan for 1425 Slate Hill Road property. Mr. Scott Steiger, owner, also explained to the Board the plan for this property. Vice President BLACK made a motion to approve the exemption from the Land Development process for the property at 1425 Slate Hill Road. Commissioner SCHIN seconded. Motion carried 5-0.

 

COMMISSIONERS REPORTS

Assistant Manager Erin Trone explained there was a grant submitted by Rebecca Davis to the Fish and Wildlife Foundation to create a water retention basin. The final word has been received that the Grant was approved for $160,000.

Solicitor Miner congratulated the elected and re-elected Commissioners and thanked them for his appointment.

Vice President Black thanked the residents that gave him so much support while he was President of this Board and it was an honor to serve. He also thanked his fellow board members.

Commissioner Kutz thanked the Board members and staff during this two month transition period since the election. He stated it was an honor to be sworn in tonight and he looks forward to a fruitful 2020 for Lower Allen Township.

Manager Vernau thanked the Board for his reappointment. He stated that the Township has a great staff and they are looking forward to 2020.

Recording Secretary Mary Ellen Banks asked the Board to put on their calendar February 29th for the Lisburn Community Fire Company’s annual banquet.

Daniel Flint thanked the Board for his reappointment and informed the Board the Gettysburg Road relocation project has finally been advertised for bids on December 24th. Expected bid opening is January 30th.

President Villone thanked everyone for coming out and he is honored to serve as President of the Board of Commissioners.
