REGULAR MEETING

AGENDA

1. Call to Order by President Villone. Proof of Publication.

2. Prayer and Pledge of Allegiance.

3. Approval of Meeting Minutes: November 9, 2020 Regular Meeting

4. Audience Participation: Any item on the agenda.

5. CONSENT AGENDA
Any Commissioner, staff member, or anyone in attendance who would like to have an item on the Consent Agenda removed for further discussion can request so now. Is there a request for the removal of an item(s) on the Consent Agenda?

Accept motion to approve the items on the Consent Agenda, which are listed as follows:

a. Department Reports for the month of October for Community Development, Facility Maintenance, Fleet Maintenance, Township Engineer, Public Works, and Public Safety.

b. Tax Collectors October Monthly Report.

6. PRESIDENT VILLONE

a. Motion to approve the Check Register of November 20, 2020 in the amount of $263,789.66.

b. Motion to approve Post Issuance Compliance Procedures following the issuance of general obligation notes to refund certain indebtedness of the Township.

c. Discussion and possible action: Resolution 2020-R-38 honoring Gordon E. Wilson for his years of service to the Lower Allen Sewer Authority and Lower Allen Stormwater Authority.

7. Any business pertinent to the Township. Discussions will be limited to fifteen (15) minutes per person.

8. TOWNSHIP ENGINEER

a. Discussion and possible action: SLD Docket No. 2020-12: Subdivision Plan for 1604 Main Street and 1608 McCormick Drive. Proposed lot line adjustment between two existing lots.

i. Motion to approve a waiver of the requirement contained in Section 192-57.C(9) to provide sidewalks along all street frontage, until such time as the installation of same has been deemed necessary by the Township for the health, safety or welfare of the general public. These improvements shall be made at the owner’s expense. This is a covenant running with the land, which shall bind the owners, their successors, heirs and assigns.
ii. Motion to approve a waiver of the requirement contained in Sections 192-57.B(2)(h)[2] and 192-57.C(8) to provide curbs on all street frontage, until such time as the installation of same has been deemed necessary by the Township for the health, safety or welfare of the general public. These improvements shall be made at the owner’s expense. This is a covenant running with the land, which shall bind the owners, their successors, heirs and assigns.
iii. Motion to approve a waiver of the requirement contained in Sections 192-57.B(2)(h)[2] 192-57.C(13) to provide fill-in paving, until such time as the installation of same has been deemed necessary by the Township for the health, safety or welfare of the general public. These improvements shall be made at the owner’s expense. This is a covenant running with the land, which shall bind the owners, their successors, heirs and assigns.

These waivers are not contrary to the public interest, and they maintain the purpose and intent of the Subdivision and Land Development Ordinance

iv. Motion to approve SLD Docket No. 2020-12, Subdivision Plan for 1604 Main Street and 1608 McCormick Drive.

b. Discussion and possible action: Approving the Declaration of Restrictive Covenant related to zoning provisions applicable to Arcona Phase 8.1.

c. Approve payment of Invoice No. 8 to JVI Group, Inc. In the amount of $428,799.63 for the Gettysburg Road Relocation Project.

9. COMMUNITY AND ECONOMIC DEVELOPMENT

a. Discussion and possible action: Ordinance 2020-08, An Ordinance amending, modifying, and changing the code of the Township of Lower Allen, Section 220-8A, the zoning map of the Lower Allen Township Zoning Ordinance of 2009, as amended, to rezone two tracts of land from R-1 Single Family established residential to R-3 Multi-Family Residential.

b. Discussion and possible action: Authorize staff to initiate the public review process for Docket ZOA 2020-03, a zoning ordinance text amendment that would add a permitted use within Section 220-37.K., permitted uses in the R-3 Multi-Family Residential District. Applicant is specifically requesting to allow outpatient mental health and substance abuse centers, only if operated in the same facility where a currently permitted use, residential mental health and substance abuse facilities, is located.

c. Discussion: Land Partnership Grant Award of $17,000.00.

a. Discussion: Ordinance 2020-12, Verizon Franchise Agreement.

a. Intervention in Regal Partners (Country Inn & Suites) assessment appeal.

b. Discussion and possible action: Approval of the First Amendment to the Collective Bargaining Agreement with the Lower Allen Township Police Officers Association of 2018-2020.
