MINUTES

PLANNING COMMISSION LOWER ALLEN TOWNSHIP
REGULAR MEETING AUGUST 17, 2021
The following were in ATTENDANCE:

Chairman McCreary called the August 17, 2021 Regular Meeting of the Lower Allen Township Planning Commission to order at 7:00 pm.  He announced that proof of publication was available for review. 

 

APPROVAL OF MEETING MINUTES

Mr. CLOVSKY moved to approve the minutes from the June 15, 2021 Regular Meeting.  Mr. LOGAN seconded.  The motion carried 4-0.

 

OLD BUSINESS

NEW BUSINESS

SLD Docket No. 2021-05:  Final Lot Line Adjustment for Baughman Residence

Christine Hunter of H. Edward Black and Associates came to the podium.  She explained the proposal is to transfer a lot line of approximately 5,000 square feet from a common parcel to 3410 Canyon Creek.  Ms. Hunter added that it is simply a land transfer and does not affect access to the open space.  Ms. Hunter noted that her firm did receive comments from Mr. McCullough and submitted the necessary revisions that day.  Mr. McCullough confirmed that his comments were addressed to his satisfaction.  He added that the County comments pertained to open space districts and TNDs, but that these parcels are not within those districts, therefore the comments from the County did not apply.  Referring to the map on the screen, Mr. Wickenheiser posed some questions on where the common area is.  Mr. McCullough explained that it is a piece of land that could not be developed due to the terrain and belongs to the HOA as common area.  Mr. Clovsky asked if emergency vehicles can get in through that open space lot.  Mr. McCullough advised that the requirement would not apply and referred to County documents that indicate the requirement only pertains to flagged lots within a conservation subdivision or open space development, which these are not.  He added that he also checked with the Public Safety department, and they agreed.

Doug Baughman of 3410 Canyon Creek came to the podium.  He advised he is the homeowner for the proposed land transfer.  He expanded on the recent discussion around the common area, stating that it is an easement for all properties in the homeowners’ association, to access the lower ground that connects to the Yellow Breeches Creek, which keeps the residents off the properties of other homeowners.

Mr. WICKENHEISER motioned to approve the final lot line adjustment for the Baughman residence.  Mr. CLOVSKY seconded.  The motion carried 4-0.

 

OTHER BUSINESS

Regional Significance and Impact Letter – Green Lane Meadows (Fairview Township, York County)

Mr. McCullough indicated he had previously sent the Commission members a copy of the letter.  He wished to discuss the letter prior to bringing up the topic to the Board of Commissioners.  He said that after having discussed the topic with Township Staff, they concluded the increased traffic would impact Green Lane Drive, the bridge over the Yellow Breeches Creek, and the intersection at Green Lane Drive and Cedar Cliff Drive.  He added that the intersection already poses safety issues, and that increased traffic has potential to be problematic.  Chairman McCreary asked if the bridge is a one-way bridge.  Mr. McCullough replied that it is not a one-way bridge but can only accommodate one car at a time.  Chairman McCreary asked if the bridge has been refurbished.  Mr. McCullough replied no, but that it is inspected yearly.  Mr. McCullough went on to say that Cumberland County was not concerned with the increase in traffic but wanted to ensure that they are meeting all the restrictions associated with the bridge.  Mr. Wickenheiser agreed that increased traffic at the intersection would be concerning.  Mr. Logan asked if the children living in the development will go to Cedar Cliff.  Mr. McCullough said yes.  Mr. McCreary asked how many homes are being built, and what kind of homes.  Mr. McCullough replied that 205 single family detached homes are in the development plans.  There was some general discussion on how the school busses would route the children in effort to avoid the impacted intersection.  Mr. McCullough stated he felt that the intersection should be improved to help accommodate the traffic.  He went on to say that nothing would be resolved that evening, and the next step would be to obtain a traffic study from Fairview Township to analyze the data.  Mr. McCullough stated that LAT is not granted the ability to object to the plan but can collaborate with Fairview Township and York County.  Discussion ensued around how residents of Lower Allen Township could be notified of the development.  Mr. Wickenheiser suggested that when Fairview Township sends out the public notice, LAT can place meeting information on its website, should a LAT resident wish to attend a Fairview Township meeting to learn more and make comments.

 

SLD Docket No. 2013-08, Preliminary Subdivision Plan for Highpoint – Status Update on Required Curb and Fill-in Paving Along Lisburn and Arcona Roads

Mr. McCullough advised he contacted Charter Homes multiple times over that past week and they had gotten back to him the prior day.  An email from Charter indicated they have been looking for a way to install curb along these roads that would not necessitate installation of a new stormwater system.  Mr. McCullough continued reading from the email, quoting Charter that there is no existing stormwater conveyance system throughout long areas of street frontage that would need to be installed once curbs go in, and that Charter states they are not required to install the storm system, but one could be needed if they move forward with the curbs.  Mr. McCullough stated that in reading prior minutes’ meeting discussions and after having consulted with Dan (the former engineer), it has been his understanding that Charter is required to complete the improvements.  Chairman McCreary stated that Charter’s requirement to complete the improvements were on the original plans, but they later requested a waiver for it, which the Planning Commission denied.  Mr. McCullough stated he is meeting with Charter the next Friday to discuss the issue and advise them they need to complete the improvements.  Mr. Clovsky suggested Mr. McCullough contact PennDOT considering the area in question is PennDOT owned.

Mr. CLOVSKY motioned to adjourn the meeting at 7:34 PM.  Mr. LOGAN seconded.  The motion carried 4-0.
