MINUTES

BOARD OF COMMISSIONERS LOWER ALLEN TOWNSHIP
REGULAR MEETING DECEMBER 27, 2021
The following were in ATTENDANCE:

President Villone called the December 27, 2021 Regular Meeting of the Board of Commissioners to order at 6:00 PM. He announced that Proof of Publication for this meeting was available for review. This was followed by a prayer and the Pledge of Allegiance. President Villone noted that Commissioner Holtzman was absent, with excuse.

 

MEETING MINUTES:

Commissioner SCHIN moved to approve the minutes from the December 13, 2021 Regular Meeting. Vice President BLACK seconded the motion. The motion carried 4-0.

 

Resolution 2021-R-41, Honoring Commissioner Richard F. Schin

President Villone announced the retirement of Commissioner Richard F. Schin and introduced the RESOLUTION. Commissioner KUTZ offered the motion to adopt RESOLUTION 2021-R-41, honoring Commissioner Richard F. Schin. Vice President BLACK seconded. The motion carried 4-0.

 

PRESENTATION:

President Villone read aloud RESOLUTION 2021-R-41.  President Villone also presented a plaque to Commissioner Schin on behalf of the Township Board of Commissioners and staff.

Next, Representative Sheryl Delozier presented a Pennsylvania House of Representatives Citation to Commissioner Schin in recognition of his service to the Township. She expressed comments of personal gratitude for his service to the Township. She also mentioned appreciation for his many years spent teaching and coaching.
Commissioner Kutz presented Commissioner Schin with a Citation from the Pennsylvania Senate on behalf of Senator Mike Regan.

Capital Region COG Director Gary Myers also had a presentation to Commissioner Schin in appreciation for his years representing Lower Allen Township to that body.

 

MEETING RECESS

Before recessing the meeting at 6:15 p.m. for a period of fellowship and cake, Commissioner Schin expressed his thanks and appreciation of the recognition and for the support from his family, his colleagues, and the residents of Lower Allen Township. Following the recess, the meeting reconvened at 6:48 p.m.

 

AUDIENCE PARTICIPATION:  Any item on the agenda.

President Villone advised the audience that if there were any item on that evening’s agenda that they wish to comment on, to please indicate as such. There were none.

 

CONSENT AGENDA:

President Villone stated that any Commissioner, staff member, or anyone in attendance who would like to have an item on the Consent Agenda removed for further discussion could do so at that time. There were none.

Items on the Consent Agenda:

a.  Department Reports for the month of November for Community Development, Fleet Maintenance, Facility Maintenance, and Public Works.

b.  Check Register of December 17, 2021 in the amount of $419,336.42.

c.  Tax Collectors November Monthly Report.

d.  Job Description for Administrative Assistant for the Public Works, Finance and Human Resources Departments.

Commissioner KUTZ moved to approve the items on the Consent Agenda. Commissioner SCHIN seconded. The motion carried 4-0.

 

PRESIDENT VILLONE:

Resolution 2021-R-40, 2022 Fee Schedule

President Villone requested a motion to adopt RESOLUTION 2021-R-40, 2022 Fee Schedule. Commissioner SCHIN made the motion. Vice President BLACK seconded. The motion carried 3-1, with Commissioner KUTZ opposing.

 

Resolution 2021-R-42, Pennsylvania Opioid Misuse and Addiction Abatement Trust

President Villone requested a motion to adopt RESOLUTION 2021-R-42 of the Board of Commissioners of Lower Allen Township, Cumberland County, Pennsylvania authorizing the Township to enter into the Settlement Agreements with McKesson Corporation, Cardinal Health, Inc., Amerisource Bergen Corporation, Johnson & Johnson, Janssen Pharmaceuticals, Inc., Ortho-McNeil-Janssen Pharmaceuticals, Inc., and Janssen Pharmaceutica, Inc., and agree to the terms of the Pennsylvania Opioid Misuse and Addiction Abatement Trust.

Commissioner SCHIN made the motion. Commissioner KUTZ seconded. The motion carried 4-0.

 

Ordinance 2021-05

President Villone requested a motion to approve the Adjudication for ORDINANCE 2021-05. Commissioner SCHIN made the motion. Commissioner KUTZ seconded. The motion carried 4-0.

 

Ordinance 2021-05 and Design Manual

President Villone requested a motion to enact ORDINANCE 2021-05, Amendments to Section 220-206 and 220-207, Wireless Communication Facilities, of the Codified Ordinances of Lower Allen Township and Design Manual. Commissioner SCHIN made the motion. The Secretary called the roll:

The motion carried 4-0:

 

Payment to JVI Group, Inc.

President Villone requested a motion to approve payment of $187,658.33 to JVI Group, Inc, for work performed on the Gettysburg Rd. Realignment Project. Commissioner SCHIN made the motion. Vice President BLACK seconded. The motion carried 4-0.

 

Resolution 2021-R-43

President Villone requested a motion to approve RESOLUTION 2021-R-43, appointing Nathaniel C. Sterling as an Administrative Assistance for the Public Works, Finance, and Human Resources Departments effective January 3, 2022. Commissioner SCHIN made the motion. Commissioner KUTZ seconded. The motion carried 4-0.

 

ANY BUSINESS PERTINENT TO THE TOWNSHIP:

President Villone noted that if anyone wished to speak on any issue affecting the Township, there would be 15 minutes allotted per person to speak at the podium. There were none.

 

MANAGER

Employee Recognition – Years of Service

Mr. Vernau stated that employee length of service recognition for six Township employees would take place during the next meeting and noted the details for each were included in the Board packet.

 

COMMISSIONERS’ REPORTS

President Villone announced that following the Commissioners’ reports, the Board members would adjourn to Executive Session for the purpose of discussing a personnel issue.

Mr. Eby expressed his congratulations to Commissioner Schin on his retirement and thanked the Board for approval of the 2022 Fee Schedule.

Mr. Vernau also expressed his congratulations to and appreciation for Commissioner Schin and their positive working relationship over the years.

Commissioner Kutz offered his congratulatory remarks to Commissioner Schin, describing him as an incredible public servant, having provided a vision of what public service should look like. He also thanked him for his continued encouragement and support.

Commissioner Kutz also noted the end of the two-year session and expressed his view that the Board had achieved a successful two years, noting pride in the accomplishments of the Township. He identified specifically steps taken to move the Township in the right direction in terms of redevelopment opportunities, commitment to public safety in the community and in the schools, new fire apparatus, providing added functionality and investment in infrastructure. He also noted the Township’s steps to preserve green space and invest in renewable energy, with initiatives that are environmentally friendly and fiscally responsible. He noted the passage of two on-time, budgets with no tax increases. He emphasized his pride in the accomplishment of meeting the goal and mission of establishing safe schools, safe streets, and a safe community. Concluding his remarks, he welcomed Commissioner-Elect Nagy who would be sworn in the following week.

Vice-President Black offered his congratulations to Commissioner Schin and stated his appreciation for their time working together. Next, he expressed his pride in the accomplishments of the Board, noting the first-class designation of the Township, and provided specific thanks to the Public Safety and Public Works staff.

President Villone congratulated Commissioner Schin, noting gratitude for his friendship, guidance, and leadership. He also offered words of praise for the administration, noting the end of the two-year session, and welcomed incoming Commissioner-Elect, Joshua Nagy. He thanked his fellow commissioners for their support and trust, noting it had been a pleasure serving as President for the past two years.

Closing the meeting, Commissioner Schin shared memories from his thirty-two years of service, stating it had been a thrill to serve and to meet so many people. He thanked the staff for making it easy to serve as a representative of the Township, noting their high level of visibility and responsiveness, and shared that he had received many compliments about the staff from residents over the years. He also thanked his family for their continued support during his tenure.

ADJOURNMENT

The regular meeting of the Board of Commissioners adjourned to Executive Session at 7:14 p.m. for discussion of a personnel matter regarding a Commissioner.
