BOARD OF COMMISSIONERS LOWER ALLEN TOWNSHIP
   
REGULAR MEETING JUNE 13, 2022

President Villone called the June 13, 2022 Regular Meeting of the Board of Commissioners to order at 6:03 PM. He announced that Proof of Publication for this meeting was available for review. This was followed by a prayer and the Pledge of Allegiance.

 

APPROVAL OF MEETING MINUTES:

May 9th, 2022 Regular Meeting:  Vice-President BLACK made a motion to approve the minutes of the May 9th, 2022 Regular Meeting. Commissioner NAGY seconded the motion. Motion carried, 5-0.

May 23rd, 2022 Regular Meeting. Vice-President BLACK made a motion to approve the minutes of the May 23rd, 2022 Regular Meeting. Commissioner NAGY seconded the motion. Motion carried, 5-0.

 

AUDIENCE PARTICIPATION:  Any item on the agenda.

President Villone advised the audience that if there were any items on that evening’s agenda that they wished to comment on, to please indicate as such. There were none.

 

CONSENT AGENDA:

President Villone stated that any Commissioner, staff member, or anyone in attendance who would like to have an item on the Consent Agenda removed for further discussion, could do so at that time. There were none.

Items on the Consent Agenda:

a.  Check Register of June 3, 2022 in the amount of $246,786.72.

b.  Release of Maintenance Guaranty for the Liberty Cove Development in the amount of $5,805.30 based upon reaching the required maintenance period and all public improvements constructed and installed in accordance with Township standards.

c.  Reimbursement agreement with Lower Allen Township Stormwater Authority for the purchase of a mini excavator.

Commissioner NAGY moved to approve the items on the Consent Agenda. Commissioner KUTZ seconded. The motion carried 5-0.

 

PRESIDENT VILLONE

Any business of the President. There was none.

Any business pertinent to the Township. Discussions will be limited to fifteen (15) minutes per person.

None at this time.

 

PUBLIC WORKS DIRECTOR

Stormwater Ordinance Advertisement

Discussion and possible action: Advertisement of Ordinance 2022-02, deleting Chapter 184, Stormwater Management, and replacing it with a new Chapter 184, Stormwater Management, per the PADEP 2022 Model Ordinance. Director Davis, Public Works, explained to the Board further the advertisement of Ordinance 2022-02. She stated this is required by our NPDES MS4 permit and also required to be completed by September 30, 2022. A copy of the ordinance was included in the Board’s packet. Vice-President Black asked for further explanation of the examples given in the memo. #1) The fire hydrant flushing/hose testing – During this, there are tablets that go over the inlet grate so that when the water goes down, the tablets remove the chlorine in the water.  We already do this.  #2) Residential vehicle wash water. Director Davis explained this is currently not in our ordinance so it will be added; DEP is requiring when a resident washes their vehicle, they must discharge this water to a grassy area or take their vehicle to a car wash. This is going to be an educational process for our residents. And, #3) DEP is no longer allowing pool water to be discharged to the stormwater system. She explained once again this is not an optional ordinance for us, it is a mandated ordinance change and the language came directly from the Commonwealth.

President Villone asks that moving forward, educating the public is a requirement on the municipality. Solicitor Miner stated the public meeting is scheduled for August 8th at 6:00 pm.  Commissioner CARON made a motion to advertise Ordinance 2022-02, deleting Chapter 184, Stormwater Management, and replacing it with a new Chapter 184, Stormwater Management, the PADEP 2022 Model Ordinance. Commissioner NAGY seconded the motion. Motion carried, 4-1, with Commissioner KUTZ opposing.

 

COMMUNITY AND ECONOMIC DEVELOPMENT

Lot line adjustment for Capital City Car Wash

Discussion & Possible Action: Mrs. Trone explained this is to approve Lot Line Adjustment LLA-2022005, Capital City Carwash, for the purpose of adjusting a lot line to include a garage that was formerly part of a neighboring parcel (Farr Family Tire). There are no conditions or waivers.

Mr. Douglas Gosik of Williams Site Civil, LLC explained this a simple lot line adjustment plan which is conveying roughly a quarter of an acre from the Farr Family Tire tract to the Capital City Car Wash tract. There is also a thin sliver that is shaded in green; that area is actually being conveyed from the Capital City Car Wash tract back to the Farr Family Tire. Trone explained that the Planning Commission has recommended this for approval. Commissioner KUTZ made a motion to approve Lot Line Adjustment LLA-2022005, Capital City Carwash for the purpose of adjusting a lot line to include a garage that was formerly part of Farr Family Tire. Vice-President BLACK seconded the motion. Motion carried, 5-0.

 

COMMISSIONERS REPORTS

Mary Ellen Banks, Recording Secretary; stated that August 10th thru the 13th is the Lisburn Community Fire Company Festival.

Erin Trone, Assistant Manager, reminded the Board that the employee picnic is tomorrow at the Public Works Building @ 11:30. She also explained that Director Davis and she will be meeting with several property owners across the street that has some occasional flooding issues. They wanted to gather them together to discuss a grant opportunity that is available from the County.

Director Holl explained that he received a phone call from the West Shore School District’s Superintendent, Dr. Stoltz. On June 9th the school board met, and he presented his cost sheets for the School Resource Officer (SRO), along with other options. What the Board asked him to pursue is one (1) SRO for each high schools and one (1) security guard for each of the middle schools which will be a private contractor. Dr. Stoltz will be looking into grant funding for this. Director Holl stated he will come back to the Board when it is further along to have it put on the agenda.

Commissioner Caron was pleased to attend the housing ceremony for the new fire truck on June 4th at Lower Allen Fire Station #2; she said it was really neat to be a part of this historical tradition of housing a new truck and was very happy to be part of this.

Commissioner Nagy, expressed thanks to Captain Crone and Director Holl for having had the honor of doing a police ride-along; it was amazing to see what happens behind the scenes. He stated our residents should be very proud and know they are well protected.

Commissioner Kutz stated how he also enjoyed the quint housing ceremony; it was a neat tradition and to be part of; he stated that he knows our fine folks appreciate that and will put that apparatus to good use. He is also looking forward to the Lisburn Community Fire Festival. He stated they are working on some exciting things for Lisburn Community Fire behind the scenes and hopefully will have more on that soon. He also stated that he is glad the West Shore School District is finally willing to come on board with the SRO program; they have been talking about this for four years. Commissioner Kutz explained when he ran, he mentioned the importance of school safety and the Township has conveyed to them how they would be so supportive of this initiative; he had sent grant information to them previously. He stated it is wonderful that the school district is finally taking school safety seriously and he will look forward to getting an SRO into the school district and to have this as an agenda item.

President Villone explained he was going to make several appointment changes. Commissioner Kutz was the primary liaison for the Capital Area Council of Governors. This will change to Commissioner Caron being the primary liaison and he will remain as the alternate. Also, Commissioner Kutz was the primary liaison to the Municipal Advisory Board which basically is the liaison to the County Commissioners which meet once a quarter. This will also change to Commissioner Caron as the primary liaison and he will remain as the alternate. He has had conversations with both of these Commissioners and these changes have been acceptable to both of them. President Villone thanked Commissioner Kutz for the time he has put in to these two organizations and congratulated Commissioner Caron.

President Villone also thanked all of the Lower Allen staff for their hard work and the Commissioners especially for being part of events and being so active in the Township.
