MINUTES

BOARD OF COMMISSIONERS                                                               LOWER ALLEN TOWNSHIP

REGULAR MEETING                                                                               DECEMBER 28, 2015

The following were in ATTENDANCE:

President Black called the December 28, 2015 Regular Meeting of the Board of Commissioners to order at 7:00 pm followed by a prayer and the Pledge of Allegiance. He announced that Proof of Publication was available for review.

APPROVAL OF MEETING MINUTES
Commissioner SCHIN moved to approve the minutes for the December 14, 2015 public hearing. Commissioner TITZEL seconded the motion. Motion carried 5-0.

Commissioner SCHIN moved to approve the minutes for the December 14, 2015 regular meeting. Commissioner BUCHER seconded the motion. Motion carried 5-0.

RESOLUTION 2015-R-34 – COMMISSIONER LLOYD W. BUCHER
Commissioner SCHIN made a motion approving Resolution 2015-R-34 honoring Commissioner Lloyd W. Bucher for his 30 years of service as a Commissioner of the Lower Allen Township Board of Commissioners. Vice President YOUNG seconded the motion. Motion carried 5-0.

RESOLUTION 2015-R-35 – COMMISSIONER JOHN T. TITZEL
Vice President YOUNG made a motion approving Resolution 2015-R-34 honoring Commissioner John T. Titzel for his 20 years of service as a Commissioner of the Lower Allen Township Board of Commissioners. Commissioner SCHIN seconded the motion. Motion carried 5-0.

PRESENTATION
Cumberland County Commissioner James Hertzler spoke about Commissioners Bucher and Titzel and called them statesmen and gentlemen. He stated they had the dedication to do what was right for Lower Allen Township. He thanked them for their service and presented them a certificate.

Pennsylvania Senator Pat Vance spoke about their leadership. She appreciated their families who allowed them to be Commissioners. She spoke about Commissioner Bucher’s work with the West Shore Tax Bureau and Commissioner Titzel dedication to fire safety. She presented them with a certificate.

Pennsylvania Representative Sheryl Delozier spoke about the teamwork of the Commissioners during their service. She spoke about the hard decisions they had to make they made were always in the best interest of the Township. She thanked them for the service and presented them with a certificate.

Ann Simonetti, Capital Region Council of Governments, thanked them for their service to the Township. She thanked Commissioner Bucher for serving as an Alternate to the COG Board over the years. She presented him with a certificate.

District Justice Charles Clement spoke about how the Commissioners guided the community in a positive way. He spoke about Codes staff and police officers who come before him and the honor they present in his courtroom.

President Black spoke about the significant part that Commissioners Bucher and Titzel played in making Lower Allen Township what is today. He thanked them for their service and their friendship. He read the full resolution of each Commissioner and presented them with the resolution and a special plaque for their years of service.

President Black thanked Roger Quigley, Patriot News, who is retiring, for his honest reporting of Lower Allen.

RECESS
The Regular Meeting of the Board of Commissioners recessed at 7:22 p.m. for a cake reception honoring Commissioners Bucher and Titzel.

RECONVENE REGULAR MEETING
The Regular Meeting of the Board of Commissioners reconvened at 7:52 p.m.

AUDIENCE PARTICIPATION: ANY ITEM ON THE AGENDA
There was no response.

CONSENT AGENDA
President Black advised that any Commissioner, staff member, or anyone in attendance could request any item on the Consent Agenda be removed for further discussion and asked if there was such request. There was no response.

Vice President YOUNG moved to approve the following Consent Agenda items:
     a. Department Reports for the month of November for Community Development, Township Engineer, Public Works, Fleet Maintenance,            Public Safety, and Economic Development.
     b. Tax Collector’s Monthly Report for November, 2015
     c. Resolution 2015-R-36, 2016 Fee Schedule.
     d. Resolution 2015-R-37, Treasurer’s Bond.
     e. Approve a Letter of Agreement with Frank E. Williamson Jr. to continue as Public Safety Director for a period of 90 days, unless                    extended by agreement of both parties, effective January 1, 2016.
     f. Reduction of Security Improvement for SLD Docket No. 2013-07, Brooks Edge, establishing a new security amount of $3,829.10 and a           new expiration date of December 28, 2016.
     g. Resolution 2015-R-40 hiring Public Safety Officer Keegan J. Toot.

Commissioner SCHIN seconded the motion. Motion carried 5-0.
PRESIDENT BLACK
Resolution 2015-R-38 – Police Chief Frank Williamson, Jr.
Vice President YOUNG made a motion to approve Resolution 2015-R-38 honoring Police Chief Frank Williamson’s years of service to the Township. Commissioner SCHIN seconded the motion. Motion carried 5-0. President Black read the entire Resolution and thanked him for his 34 years of service. He spoke about the high standards in place in the Police Department because of his efforts.

Approval of Check Register
Vice President YOUNG made a motion to approve Check Register of December 25, 2015, in the amount of $273,636.81. Commissioner BUCHER seconded the motion. Motion carried 5-0.

ORDINANCE 2015-06- 2016 Budget
Commissioner BUCHER moved to approve Ordinance 2015-06, an Ordinance of the Board of Commissioners of Lower Allen Township, Cumberland County, Pennsylvania, appropriating specific sums estimated to be required for the specific purposes of the municipal government, hereinafter set forth, during the Fiscal Year 2016.

Ordinance 2015-06 was approved by a 5-0 vote.

ORDINANCE 2015-08- Tax Rates for 2016
Commissioner SCHIN moved to approve Ordinance 2015-08, an Ordinance of the Board of Commissioners of Lower Allen Township, Cumberland County, Pennsylvania, fixing the Real Estate Tax rates for the Fiscal Year 2016.

                                Commissioner Bucher – Aye

Ordinance 2015-08 was approved by a 5-0 vote.

ORDINANCE 2015-09- Parking
Commissioner YOUNG moved to approve Ordinance 2015-09, an Ordinance of the Board of Commissioners of Lower Allen Township, Cumberland County, Pennsylvania, amending the Code of The Township of Lower Allen, 1997, by adding a parking prohibition at Section 209-63.

Ordinance 2015-09 was approved by a 5-0 vote.

Resolution 2015-R-39, 2015 Budget Adjustment.
Vice President YOUNG made a motion to approve Resolution 2015-R-39, a 2015 Budget Adjustment. Commissioner BUCHER seconded the motion. Motion carried 5-0.

Officer Kenneth Stirling
Vice President YOUNG made a motion to move Kenneth Stirling from probationary to regular full-time employment status in the position of Police Officer. Commissioner SCHIN seconded the motion. Motion carried 5-0. Vice President Young spoke of a ride-along he did with Officer Stirling on Christmas day and how impressed he is with the new officer.

ANY BUSINESS PERTINENT TO THE TOWNSHIP
There was no response.

COMMUNITY DEVELOPMENT
SLD Docket 2015-08 – Highpoint Phase 1.5
Mr. Flint stated the Board has seen this plan and Charter Homes is asking for action on this plan tonight if possible. He stated there are normal outside approvals necessary and the recreation language has been added. Mr. Faranda-Diedrich, Charter Homes, stated they have no issues with complying with the Township’s comments.

Commissioner SCHIN made a motion to approve SLD Docket No. 2015-08: Final Subdivision and Land Development Plan for Highpoint, Phase 1.5, contingent upon the following:
       1. Approval by the Cumberland County Conservation District.
       2. Providing an executed Developers Agreement and related Improvement Security.
       3. Providing an executed SWM Maintenance and Monitoring Agreement.
       4. Amending the language in the Overall Master Plan Recreation Sections 3d, Public Dedication and Access, and 3e, Maintenance, to                 clearly indicate that walking trails will remain open to the public but will not be dedicated to the Township.

Commissioner BUCHER seconded the motion. Motion carried 5-0.

SLD Docket 2015-10 – Arcona Phases 2.1 and 2.2
Mr. Flint explained the phase change Charter Homes made from Phase 2A to 2.1 and 2.2. He stated the presented plan is the same as the Preliminary plan. He stated there are several contingencies including pipelines through the property, HOP process for Strong Road and clarification of the master plan with recreation. Mr. Faranda-Diedrich stated they have no issues with complying with the Township’s comments.

Commissioner BUCHER made a motion to approve SLD Docket No. 2015-10: Final Subdivision and Land Development Plan for Arcona, Phases 2.1 and 2.2, contingent upon the following:
       1. Providing documentation that permission has been granted for the proposed work within easements from: SPLP; SPREA; PPL;                   Keystone Pipeline; and Columbia Gas Pipeline.
       2. Providing a copy of the recorded declaration that addresses the required percentage of single family detached residential units.
       3. Obtaining a PennDOT Highway Occupancy Permit for the Strong Road connection to Rossmoyne Road, in accordance with the                     Memorandum of Understanding.
       4. Providing the Recreation Budget for Phase 2A.
       5. Providing fire hydrants in locations approved by Lower Allen Fire Co.
       6. Approval by the Cumberland County Conservation District.
       7. Providing an executed Developers Agreement and related Improvement Security.
       8. Providing an executed SWM Maintenance and Monitoring Agreement.
       9. Approval from Norfolk Southern for stormwater discharge.
       10. Amending the language in the Overall Master Plan Recreation Sections 3d, Public Dedication and Access, and 3e, Maintenance, to               clearly indicate that walking trails will remain open to the public but will not be dedicated to the Township.

Vice President YOUNG seconded the motion. Motion carried 5-0.

MANAGER
Employees Years of service and Performance Award Nominations
Mr. Vernau discussed the employees who will be honored at the January 11, 2016 meeting. He stated two are being recognized for years of service and one for a service award.

COMMISSIONERS REPORTS
Mr. Flint discussed the practice of the Township appointing HRG as consulting engineer firm each year. He discussed the previous benefits of this practice and how there is no longer any benefit to appointing one. Discussion ensued. The Board agreed to not appoint a consulting engineer in 2016.

Mr. Grove stated he enjoyed working with Commissioner Bucher and Titzel over the years of his career at Lower Allen. He spoke about their motivation and thanked them for their service. Mrs. Echterling thanked them for their service to the Township and for assisting the Township with finances and public safety over the years. Mr. Vernau also thanked them.

Commissioner Bucher thanked everyone for their remarks tonight. He stated it has been satisfying working on the Board over his years of service.

Vice President Young thanked Commissioner Bucher and Titzel. He spoke about the makeup of the Board over the years. He thanked Chief Williamson for his years of service. He thanked Roger for always keeping Lower Allen Township in the news.

Commissioner Schin asked about the traffic and speeds on Creek Road. Lieutenant Thomas stated he would look into it. Commissioner Schin spoke about the Commissioners and their positive approach to the Board.

Commissioner Titzel stated he enjoyed working on the Board. He spoke about the cooperation and expertise on the Board. He thanked the Board and staff for their service.

Solicitor Miner thanked Commissioners Bucher and Titzel for their service and integrity. He stated they treat each other with respect. He thanked Chief Williamson for his service.

Chief Williamson spoke about experience working for the Township. He thanked Commissioner Bucher for his assistance with finances and Commissioner Titzel for his public safety experience. He stated it has been an honor and privilege working with everyone over the years.

Helen Titzel thanked everyone for tonight’s meeting. She has enjoyed coming to the meetings.

Commissioner-Elect Carolyn Holtzman stated she was sorry to see them go. She stated Commissioner Titzel always got things done and she plans on picking Commissioner Bucher’s brain as she comes onto the Board.

President Black spoke about his experience with Chief Williamson. He stated he has enjoyed working with those retiring tonight.

RECESS TO EXECUTIVE SESSION
The Regular Meeting of the Board of Commissioners adjourned to Executive Session at 8:39 pm to discuss the following item:

a. Appointment of a police officer to lead the police department following the retirement of Chief Williamson, to be effective January 1,         2016.

RECONVENE REGULAR MEETING
The Regular Meeting of the Board of Commissioners reconvened at 9:10 p.m.

Commissioner BUCHER made a motion to create a Lieutenant in Charge position in the Police Department of Lower Allen Township until a Captain of the Police Department is hired. Commissioner SCHIN seconded the motion. Motion carried 3-2.

Commissioner BUCHER made a motion to appoint Lieutenant Leon Crone to the position of Lieutenant in Charge of the Lower Allen Police Department, effective January 1, 2016. Commissioner SCHIN seconded the motion. Motion carried 5-0.

The Board of Commissioners meeting adjourned at 9:13 pm.
