MINUTES

STORMWATER AUTHORITY LOWER ALLEN TOWNSHIP
REGULAR MEETING JULY 7, 2022
The following were in ATTENDANCE:

Chairman Johnson called the July 7, 2022, Regular Meeting of the Lower Allen Township Stormwater Authority to order at 8:17 pm. He announced the meeting had been duly advertised for publication. The recording secretary called the roll.

APPROVAL OF MEETING MINUTES

Ms. SHULER moved to approve the minutes from the May 4, 2022, Regular Meeting. Mr. SCHIN seconded the motion. The motion carried 4-0 with Mr. Johnson abstaining since he was absent from the prior meeting.

AUDIENCE PARTICIPATION

There was none.

SOLICITOR’S REPORT

Mr. Miner reported one recorded, satisfied lien for a delinquent account.

TREASURER’S REPORT

Mr. Schin reported the June 27, 2022, cash balance of the Fund was $2,907.044.

Disbursement requisition transfer $143,045 motion to make the transfer. 2nd. Bucher motion carries 5-0.

Mr. SCHIN motioned to approve the Treasurer’s Report. Mr. EDWARDS seconded the motion. The motion carried 5-0.

Mr. SCHIN motioned to authorize a disbursement requisition transfer to the General Fund for Q12022, the amount of $143,045. Mr. BUCHER seconded the motion. The motion carried 5-0.

PUBLIC WORKS DIRECTOR REPORT:

Stormwater Fee Credit and Appeals Monthly Report

Ms. Davis reported no submissions since the prior meeting.

Lower Allen Township Stormwater Authority and Township Reimbursement Agreement

Ms. Davis presented the agreement for discussion and approval. She explained the agreement was signed by the Board of Commissioners President and relates to the reimbursement for the purchase of a mini excavator at an 80/20 split for the cost of the equipment. The township has approved reimbursing in 2023 when ARPA funds become available.

Ms. SHULER motioned to authorize execution of the agreement, seconded by Mr. BUCHER. The motion carried 5-0.

Lower Allen Township Stormwater Ordinance Amendment

Ms. Davis introduced the topic for discussion and comment. The revised Stormwater Ordinance is due to an update required by the PA Department of Environmental Protection for the MS4 permit. The township must submit the ordinance for review to several governing bodies, including the stormwater authority. It has been submitted to the Cumberland County Planning Department, the Lower Allen Township Planning Commission, and there will be a public hearing on August 8, 2022. The ordinance could be adopted at that meeting. The main changes to the ordinance include riparian buffer requirements and two sections for permitted discharges: residential vehicle wash water and pool water discharge. She further explained that DEP requires the changes to be adopted by 9/30/2022 or the township can be fined. The Stormwater Authority is being asked to provide comments on the ordinance either prior to or at the public hearing on 8/8/22.

Mr. Schin noted it would cost the taxpayers if the township did not adopt the change. He asked if there were any reason not to adopt the revised ordinance. Ms. Davis said there was not.

Mr. Edwards asked what enforcement actions would be taken by the township. Ms. Davis said that resident education would be prioritized rather than enforcement through fines. Residents will be education through information provided through the township newsletter, door hangers, social media, etc.…

Mr. Johnson requested a summary of the changes in the ordinance be sent to members for review. Ms. Davis affirmed that she would provide that by email.
