MINUTES

STORMWATER AUTHORITY LOWER ALLEN TOWNSHIP
REGULAR MEETING DECEMBER 7, 2023
The following were in ATTENDANCE:

Chairman Johnson called the December 7, 2023, Regular Meeting of the Lower Allen Township Stormwater Authority to order at 7:25 pm. He announced the meeting had been duly advertised for publication.

APPROVAL OF MEETING MINUTES
Ms. SHULER moved to approve the minutes from the November 2, 2023, Regular Meeting.  Mr. BUCHER seconded the motion.  The motion carried 5-0.

SOLICITOR’S REPORT
Mr. Miner presented an update on the West Chester Borough and University case, noting that the late filed state system brief was accepted on October 31, 2023 and the Borough of West Chester timely filed its brief on November 14, 2023. He noted the matter is significant with statewide implications, so oral arguments are anticipated and there should be a decision sometime in the spring.

TREASURER’S REPORT
Mr. Schin reported the total cash balance, as of November 30, 2023 was $3,930,442, an increase of $160,112 since the prior meeting.

Property

Below is a summary report of Stormwater billing accounts deemed “Uncollectable” with total balances through 11/30/2023.  These balances include past due principal amounts plus penalties through the last billing period (2023-Q4). Late penalties for 2023-Q4 are reflected in the figures.

Mr. SCHIN motioned to approve the Treasurer’s Report.  Ms. BUCHER seconded the motion. The motion carried 5-0.

Mr. Edwards asked for more detail about the additional turnpike account. Director Davis noted the location was near the Meridian apartments. She also pointed out that the account for the railroad had been removed from the list due to their satisfaction of the debt.

Next, Mr. Schin reported a transfer in the amount of $205,590 for Q3.

Mr. SCHIN motioned to approve the transfer.  Mr. EDWARDS seconded the motion. The motion carried 5-0.

PUBLIC WORKS DIRECTOR REPORT:
Credit and Appeals Monthly Report
Director Davis reported on receipt of a credit application from the West Shore School District for Rossmoyne Elementary School. They will be granted a 50% reduction in the stormwater fee as they are mitigating 100% of the stormwater due to the design of the new school including four BMPs on site.

2023 Infrastructure Project Payment Estimate #2
Director Davis provided an update on the project and staff recommendation for approval of payment estimate number two for the project which was awarded to Kinsley Construction Inc. in the amount of $1,909,886.00. The estimate represents the work performed, inspected, and approved by the Township to date for the project. The Township retains 5% of the payment amount of work completed to date since the project has reached 50% completion. Staff recommends approval of the estimate by the Authority, in the amount of $551,508.74 for the stormwater infrastructure improvements in the payment estimate.

Chairman Johnson confirmed that payment was the amount invoiced.

Ms. SHULER motioned to approve the payment.  Mr. EDWARDS seconded the motion. The motion carried 5-0.

Director Davis noted that the Township work on the project is near completion, however the water company is still replacing lines and the paving will be completed in 2024.

2023 Infrastructure Project Update
Director Davis presented an update of the project. Kinsley Construction has finished the pavement milling and paving in the Lower End of the Highland Park neighborhood. Progress continues in the Allendale development, consisting of replacing stormwater infrastructure and new ADA ramps. A map identifying the work completed for stormwater infrastructure as well as ADA ramps was provided, along with pictures showing the condition of the old pipe being replaced and some of the ADA ramps. She noted there are ten ADA ramps left to complete and noted they will have to come back and seed and clean out inlets and flush lines in spring. Additionally, $4000 was raised from the scrap metal pipe removed from the ground and would be deposited back into the stormwater fund.

Beacon Hill Basin Update
Director Davis presented an update on the project. She noted that the basin has been holding a shallow amount of water after rain events and needs repair.  Following consultation with the contractor, Stormwater Maintenance Consultants, LLC, and the Township Engineer it was determined that the best solution would be to remove the geotextile fabric that surrounds the underdrain and install stone in the bedding of the drain to see if the water can reach the drain and flow out of the basin. The contractor will perform the repairs and install new plants during the early spring of 2024. Repairs and new plants are covered under the warranty.

Other Business
Meeting dates and times for 2024 were included in the meeting materials provided. Meetings will be held at 7:30 PM or immediately following the Sewer Authority meetings on the following dates in 2024:

January 4, February 1, March 7, April 4, May 2, June 6, July 11, August 1, September 5, October 3, November 7, and December 5.

Chairman Johnson brought up an issue discussed at the Sewer Authority meeting, which was a proposed sanitary sewer for a new truck repair facility being considered. Director Davis confirmed and noted both she and the Township Engineer had reviewed the plan to install a new basin and stormwater system. She noted that she would include the plan in the January meeting packet for review.

Ms. Shuler expressed appreciation for communication related to the leaf collection this year, noting the improved coordination. Director Davis noted that staff were considering designating specific weekdays for each neighborhood for future years. Mr. Schin expressed support for that idea, noting it was helpful for residents to know what day the collection will take place. Director Davis agreed, and noted the idea would be to continue with the same schedule for spring street sweeping.

Members engaged in a brief discussion about the new refuse contract. Director Davis briefly reviewed the details of the new contract and the potential issues that might be anticipated.

ADJOURNMENT
With no other business pertinent to the Authority, Chairman Johnson wished everyone Happy Holidays. The Regular Meeting of the Stormwater Authority adjourned at 8:00 PM.
